Created by artist Rodney Jackson in 2019, it was exhibited as part of a series of art installations entitled \u201cReFrame\u00a0<a id=\"auto-tag_miami-beach\" href=\"https:\/\/www.atelierauction.com\/globalupdates\/\" data-tag=\"miami-beach\">Miami Beach<\/a>,\u201d commissioned by the city of Miami Beach each year for its Urban Beach Weekend.<\/p>\n<p>City officials removed the work before the end of the exhibition period, calling it \u201cdivisive\u201d and \u201cinaccurate,\u2019 in their statements defending the move.<\/p>\n<p>U.S. District Judge Marcia Cooke decided that because the artworks in the exhibition \u2014 including the Herisse portrait \u2014 had been commissioned by the city, it constituted \u201cgovernment speech\u201d and was therefore immune to free speech challenges.<\/p>\n<p>In June, The American Civil Liberties Union (<a id=\"auto-tag_aclu\" href=\"https:\/\/www.atelierauction.com\/globalupdates\/\" data-tag=\"aclu\">ACLU<\/a>) of Florida\u00a0<a href=\"https:\/\/www.facebook.com\/AtelierAuctionsg\" target=\"_blank\" rel=\"nofollow noopener\">filed a lawsuit against Miami Beach officials<\/a>\u00a0on behalf of Jackson and the event\u2019s curators Octavia Yearwood, Naiomy Guerrero and Jared McGriff over the removal of the painting. The suit alleged that the removal of the artwork violated the group\u2019s First Amendment rights.<\/p>\n<p>Herisse was killed while driving in a car through the area where the Urban Beach Weekend is held each year. The festival has drawn criticism by civic groups for being heavily policed by local authorities.
