Allen requested that a Colorado federal court reverse a U.S. copyright office\u00a0<a href=\"https:\/\/www.atelierauction.com\/globalupdates\" data-id=\"https:\/\/www.artnews.com\/art-news\/news\/ai-generated-artwork-colorado-state-fair-copyright-decision-1234679341\/\" data-type=\"link\">decision to reject copyright protection<\/a>\u00a0for an award-winning image he made using AI.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">In the lawsuit, Allen claims that he should receive copyright for his piece\u00a0<em>Th\u00e9\u00e2tre d\u2019Op\u00e9ra Spatial<\/em>\u00a0as an expression of his creativity. He applied for a copyright registration for the work, depicting a futuristic royal court, which won the state\u2019s art fair competition in 2022.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">Allen has said in a statement that the copyright office\u2019s decision \u201cput me in a terrible position, with no recourse against others who are blatantly and repeatedly stealing my work.\u201d<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">He created the artwork using the generative AI system Midjourney, wherein he tested hundreds of prompt iterations and subsequently made changes with Adobe Photoshop. When he refused to disclaim the parts of the image generated by Midjourney, however, the office rejected Allen\u2019s application.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">The decision was affirmed by a copyright office tribunal last year, as the image was found to contain too much AI-generated material to be copyrightable.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\u201cMr. Allen had a specific artistic idea, conceived of in his mind, and he used <a href=\"https:\/\/www.facebook.com\/AtelierAuctionsg\">Midjourney<\/a> as a tool to create an artistic expression of that idea,\u201d the lawsuit said. \u201cSuch creative input is on par with that expressed by other types of artists and is capable of copyright protection.\u201d<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">This is hardly the first time an artist working with AI has been denied copyright protection.
